Terms and Conditions

NOLAND SAILING TRIP AGREEMENT

This document outlines the conditions, expectations, and responsibilities for participating in an offshore sailing expedition aboard the yacht MICA, organized by Nuno Micaelo / EVS Unip Lda.
By submitting payment and stepping aboard, you agree to all the terms and conditions described below.

1. Traveler Personal Information
To ensure safety, preparation, and insurance compliance, each traveler must provide:

Full name and age

Special dietary needs (e.g., vegetarian, vegan, allergies)

Favorite dishes or comfort foods (helps with provisioning)

Relevant medical conditions we should be aware of (e.g., heart conditions, diabetes, asthma, claustrophobia, allergies)

This information allows us to create a safer and more enjoyable experience tailored to your individual needs.

2. Sailing Trip Details

To be defined and communicated closer to the departure date. This section will include:
– Departure and arrival ports
– Approximate travel dates
– Meeting location and time
– Route overview

3. What to Bring
Each crew member must bring essential items for comfort, hygiene, and safety. See Section 8 below for a full packing list. These are mandatory.

4. Getting to the Marina
You are responsible for your transportation to and from the departure and arrival ports. We are happy to assist with directions or guidance on public transport, taxis, or nearby accommodations if needed.

5. Payment
Payment is made in two parts:

20% deposit upon confirmation

80% balance at a later date (you will receive a separate email with instructions and deadlines)

What is included:

All on-board meals, beverages, fuel, safety gear, sailing instruction, and port fees

Not included:

Transportation to/from the marina

Meals and beverages consumed ashore

Personal gear listed in Section 8

Refund Policy:

100% refund if you cancel 7 days or more before departure

100% refund if we cancel due to weather or operational reasons

6. Insurance
This expedition is covered by Pantaenius Maritime Insurance, policy number 151705346, which includes coverage for the vessel, crew, and Skipper during maritime tourism activities.

For your added protection, we recommend you acquire personal travel insurance covering:

Medical evacuation

Trip cancellation

Lost or damaged belongings

Repatriation and personal liability

7. Terms and Conditions
A. Deposit & Cancellation
Once your application is accepted, you will receive an invoice.

A 10% non-refundable deposit confirms your spot.

The remaining balance is due 30 days before departure.

Cancel at least 7 days in advance, and all payments will be fully refunded. If the trip is canceled on our side, your payment will also be fully refunded.

B. Assumption of Risk
Offshore sailing carries inherent risks. By participating, you voluntarily accept all such risks and release Nuno Micaelo, EVS Unip Lda., and associated parties from legal liability for injuries, illness, loss, or death.

Acknowledgment of Risk
“I understand and accept that offshore sailing involves unpredictable and potentially hazardous conditions, including but not limited to storms, high winds, falls, illness, limited access to medical care, and isolation at sea. I assume full responsibility for my participation and waive all claims against the organizer or its representatives. I agree to settle any legal dispute exclusively in Oliveira do Bairro, Distrito de Aveiro, Portugal.”

C. Expectations On Board
Life at sea is intense. It can be wet, cold, exhausting, uncomfortable, and exhilarating. This is not a luxury cruise. You are part of the crew, and your participation helps the group function.

You may be expected to:

Stand watch (day or night)

Steer and adjust sails (under supervision)

Maintain cleanliness in shared spaces and your cabin

Assist with meal prep or washing dishes

Everything on board is a shared responsibility. Your attitude and willingness to cooperate are essential.

D. Safety and Team Operations
Priorities on board follow this order: 1. Safety → 2. Comfort → 3. Speed

On Day 1, we conduct:

A full safety briefing

Assignment of watch rotations

Familiarization with emergency procedures

Never put yourself or others in danger. Always wake the Skipper if you are unsure or if something seems wrong—there are no bad questions at sea.

E. Behavior and Conduct
The following actions will result in immediate removal from the yacht (with no refund):

Smoking inside the vessel

Possession or use of illegal drugs

Violence, harassment, or aggressive behavior

Repeated disruption of the group dynamic

Refusal to follow safety instructions

Intentional damage to the boat

You will be disembarked at the nearest port and reported to the relevant authorities if necessary.

F. Living Space
MICA accommodates up to 6 travelers, in two cabins and one saloon (each hosting 2 people).

Cabins are assigned on a first-paid, first-served basis

Beds are shared via a “hot bunk” system during shift cycles

Food is not allowed in sleeping areas

Each guest has a designated dry storage and wet gear compartment

G. Meals and Provisions
One hot meal prepared daily (usually dinner)

Staples include pasta, rice, beans, canned protein, fruits, biscuits, and snacks

Hot water for tea/coffee is available

Share food prep and cleanup as needed

Please inform us of allergies in advance

You may eat anywhere on the boat except in cabins and near navigation equipment.

H. Watch Shifts
The Skipper will assign rotating watch shifts in pairs, including overnight.
Be ready to:

Wake up 15 minutes before your shift

Wake your shift partner if needed

Ensure the next shift is awake and briefed

Being alert and timely ensures everyone’s safety.

I. Weather & Routing
We will never sail in unsafe weather conditions.
If the weather deteriorates, the route or arrival port may change.
You may experience motion sickness, fatigue, or stress—this is part of the adventure.

8. What to Bring (Mandatory Gear)
Alarm clock or smartphone

Sleeping bag

Personal hygiene kit

Bath towel

3–5 changes of underwear

Base layers (Lycra, synthetic; avoid cotton)

Mid- and outer layers (fleece, wool, waterproofs)

Swim shorts

Sea coat & sea pants

Sea boots

Deck shoes (non-marking)

Waterproof gloves

Sunglasses, hat, and sunscreen

Seasickness tablets and personal meds

Passport (valid 7+ months) and Citizen Card (valid 1+ month)

Rechargeable headlamp (USB/AA/AAA)

Laundry bag (plastic or waterproof)

9. Additional Terms and Provisions
A. Medical Clearance
If you have any existing medical condition (e.g., heart issues, epilepsy, diabetes), please consult your doctor before joining. We are not equipped for emergency medical care onboard.

B. Personal Travel Insurance
We strongly recommend purchasing personal travel insurance that covers:

Medical emergencies

Emergency evacuation

Trip delays or cancellations

Theft or damage to personal belongings

C. Damage Liability
Participants may be held financially responsible for intentional or grossly negligent damage to the vessel, gear, or other property.

D. Media Use & Consent
We may take photos and videos during the trip for promotional or educational purposes.

By participating in this trip, you grant permission to use your likeness in any media content produced, including but not limited to promotional materials, social media, and website galleries. If you do not wish to appear in any images, please let us know in advance.

E. Force Majeure
We are not liable for delays, interruptions, or cancellations caused by events outside our control, including but not limited to:

Natural disasters

Political unrest

Port closures

Pandemics or public health emergencies
